RD LAW ON EQUALITY MEASURES, PATERNITY LEAVE IS EXTENDED TO TWELVE WEEKS FROM JANUARY 1st, 2020.
- This Royal Decree includes the extension of paternity leave.
- The RD establishes leave as mandatory for the parent other than the biological mother.
- This leave is foreseen, that in 2021 will be equal to that of the Biological Mother, that is to say, that both parents have the same time of leave, which will be called PATERNITY LEAVE.
- From January 1st, the parent who is not the biological mother must take 4 weeks of compulsory leave immediately after the birth or adoption and the remaining 4 weeks until the newborn is 1 year old.
- The birth will suspend the employment contract of the parent other than the Biological Mother for 16 weeks, of which the 6 uninterrupted weeks immediately following the birth will be obligatory.
- The first 6 weeks may be enjoyed on a full-time basis, and the remaining 10 weeks may be enjoyed on a part-time basis.
- The equalization of this leave will be carried out progressively as follows:
- In 2019, it was 8 weeks.
- In 2020 it has increased to 12 weeks. The biological mother can give up to two weeks of her leave to the father.
- And in 2021 it will reach 16 weeks, the same length as the maternity leave. The terms of equality, non-transferability and 100% remuneration are established.
